6. Why information is used and the legal basis

Personal information is only processed when there is a lawful basis under applicable data-protection law.

To deliver a purchase or provide a service
Information is used to process your order, provide access, communicate about delivery and respond to support questions. The legal basis is performance of a contract or taking steps at your request before entering into a contract.

To manage accounts and ongoing access
Information is used to maintain customer accounts, subscriptions, course access and community participation. The legal basis is performance of a contract.

To send marketing emails
Marketing emails are sent where you have given consent or where another lawful basis permits them. You can unsubscribe at any time. The legal basis is consent or legitimate interests where applicable.

To operate and protect the business
Information may be used for website security, fraud prevention, troubleshooting, record keeping and protecting legal rights. The legal basis is legitimate interests or compliance with a legal obligation.

To meet legal and financial obligations
Transaction and business records may be kept for accounting, tax, regulatory and legal purposes. The legal basis is compliance with a legal obligation.

To understand and improve the website
Analytics may be used to understand website performance and how visitors use the site. Non-essential analytics are used with consent where required. Essential technical information may be processed based on legitimate interests in maintaining a secure and functional website.

To run advertising
Where advertising tools are enabled, information may be used to measure campaigns, build audiences or show relevant advertising. These tools are activated with consent where required.

When processing is based on legitimate interests, Jacky + Co. considers the business purpose, the information involved and the impact on your privacy.

7. Email marketing

You may receive marketing emails after subscribing through a form, requesting a resource or otherwise giving permission.

Every marketing email includes an unsubscribe option. You can also ask to be removed by emailing hello@jakoliensok.com.

Unsubscribing from marketing does not stop essential emails needed to deliver a purchase, manage an account, confirm a transaction or respond to your request.

A limited suppression record may be kept after you unsubscribe so that your preference continues to be respected.

8. Purchases and payment information

Purchases may be processed through external checkout and payment providers. These providers process payment and billing information under their own privacy policies.

Jacky + Co. may receive information such as your name, email address, billing country, purchase details, payment status and transaction reference. Full card details are normally handled by the payment provider.

Transaction records may be kept for customer support, fraud prevention, accounting, tax and legal purposes.

9. Service providers

Jacky + Co. uses service providers to operate the website and deliver products, communications and customer access.

Key providers may include:

  • WordPress and website-hosting providers for the public website
  • Flodesk for email communication, forms and related customer journeys
  • Teachery for course, product, membership or community delivery
  • Stripe and connected checkout providers for payments
  • Notion for internal business operations, forms and customer-facing resources where applicable
  • analytics and advertising providers where those tools are enabled with the required consent
  • technical, security and professional advisers where reasonably necessary

These providers may only receive the information needed for their role. They process information under their own privacy terms and, where applicable, data-processing agreements.

A provider may be replaced as the business changes. This policy will be updated when a change materially affects how personal information is handled.

Personal information may also be disclosed where required by law, needed to protect legal rights or necessary in connection with a business restructuring or transfer.

10. International data transfers

Some service providers may process information outside the European Economic Area.

Where a transfer requires additional protection, Jacky + Co. relies on an applicable adequacy decision, approved contractual protections or another lawful transfer mechanism.

You can contact hello@jakoliensok.com if you have a question about the safeguards used for a particular provider.

11. AI-assisted processing

Jacky + Co. uses AI tools to support drafting, planning, educational resources and business operations.

Identifiable customer and member information is not intentionally uploaded to general-purpose AI tools for model training. Where an AI feature is used through a business platform, information is handled according to the platform’s available privacy settings, provider terms and this Privacy Policy.

AI may help organise or draft material, though publishing and business decisions remain human-led. Jacky + Co. does not use solely automated decision-making that produces legal or similarly significant effects for customers.

More information about how AI supports the business is available in the AI Use Disclosure.

12. Sensitive personal information

Information about health, disability or neurodivergence may be sensitive personal information under data-protection law.

You may choose to share this information when asking for support or explaining what you need. Jacky + Co. will only use voluntarily provided sensitive information to respond to your request, provide appropriate support or meet a legal obligation where permitted by law.

Please avoid including sensitive information that is not needed for the request. Sensitive information will not be used for unrelated marketing or advertising purposes.

13. Cookies and similar technologies

Cookies are small files stored on your device when you visit a website. Similar technologies may also be used to remember preferences, measure website activity or support advertising.

The website may use these categories:

Essential cookies
These support website security, page loading, checkout functions and other services needed for the site to work. They do not require consent where they are strictly necessary.

Preference cookies
These remember choices that improve how the website works for you.

Analytics cookies
These help measure website traffic, page performance and visitor behaviour.

Advertising cookies and pixels
Where enabled, these may measure advertising results, connect website activity with an advertising platform or support audience-based advertising.

Non-essential cookies and pixels remain disabled until you give consent where consent is required. You can accept, reject or change your choices through the website’s cookie banner or settings tool.

The live cookie banner should show the current cookies, providers, purposes and storage periods detected on the website. You can also manage or delete cookies through your browser settings.

Withdrawing consent does not affect processing that took place before consent was withdrawn.

14. How long information is kept

Personal information is kept only for as long as reasonably needed for the purpose for which it was collected, including legal, accounting and dispute-resolution requirements.

In general:

  • purchase and invoice records are kept for the period required by Dutch tax and accounting law
  • customer and account information is kept while access or a customer relationship remains active, followed by a reasonable administration period
  • support messages and form responses are kept while the request is handled and for a reasonable period afterwards
  • marketing information is kept until you unsubscribe, object or the information is no longer useful for the stated purpose
  • consent and suppression records may be kept to demonstrate compliance and respect your preferences
  • cookie information is kept for the periods shown in the live cookie settings tool

Information may be deleted earlier when it is no longer needed, subject to legal record-keeping requirements.

15. How information is protected

Jacky + Co. uses reasonable organisational and technical measures to protect personal information. These may include restricted access, account security, reputable service providers and appropriate access controls.

No online system can guarantee absolute security. If a personal-data breach creates a legal reporting obligation, the relevant authority and affected individuals will be notified as required by law.

16. Your data-protection rights

Depending on your location and the circumstances, you may have the right to:

  • ask for access to your personal information
  • ask for inaccurate information to be corrected
  • ask for information to be deleted
  • ask for processing to be restricted
  • receive certain information in a portable format
  • object to processing based on legitimate interests or direct marketing
  • withdraw consent at any time where processing relies on consent
  • lodge a complaint with a data-protection authority

Withdrawing consent does not affect the lawfulness of processing that took place before withdrawal.

To exercise a right, email hello@jakoliensok.com. Information may be requested to confirm your identity before acting on the request.

If you are in The Netherlands, you may also lodge a complaint with the Autoriteit Persoonsgegevens. Information is available at autoriteitpersoonsgegevens.nl.

17. Children

The website and paid offers are intended for adults. Jacky + Co. does not knowingly collect personal information from children.

If you believe a child has provided personal information, email hello@jakoliensok.com so it can be reviewed and removed where appropriate.

18. External links

The website and resources may link to external websites or platforms. Jacky + Co. is not responsible for the privacy practices of those external services.

Please read the privacy policy of an external service before providing personal information through it.

19. Changes to this policy

This policy may be updated when the website, business tools or legal requirements change.

The latest revision date will be shown at the top of the page. Material changes will be communicated where required by law.
